Acceptable Usage Policy (AUP)

This Acceptable Usage Policy (“Policy”) governs the use of all products, services, software, websites, and application interfaces provided by Erino (collectively, “Erino Services”). The Policy applies to all individuals and entities who access or use Erino Services, whether directly or through an authorized partner or reseller. Its purpose is to ensure that all users operate in a lawful, secure, and responsible manner that maintains the integrity and reputation of both Erino and its customers. By accessing or using Erino Services, you agree to comply with this Policy and are responsible for any violation that occurs under your account or through any person acting on your behalf.

You are solely responsible for your use of Erino Services and for ensuring that such use complies with this Policy, applicable laws, and the terms of your subscription agreement. You must take all reasonable measures to prevent unauthorized access to your account and to safeguard credentials, data, and system access. You are required to immediately notify Erino of any known or suspected violation of this Policy or any unauthorized access, data breach, or compromise involving your account. Erino reserves the right to investigate and take appropriate action to enforce compliance, including suspension or termination of access.

All use of Erino Services must comply with applicable local, national, and international laws, regulations, and industry standards. This includes, without limitation, data protection and privacy laws such as the General Data Protection Regulation (GDPR), the Information Technology Act of India, the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), Canada’s Anti-Spam Legislation (CASL), and all regulations issued by the Telecom Regulatory Authority of India (TRAI). You are solely responsible for determining which laws apply to your communications and ensuring full compliance in every jurisdiction where your contacts or recipients are located.

You may not use Erino Services in any manner that is unlawful, deceptive, harmful, or disruptive to others. Prohibited conduct includes, but is not limited to, sending unsolicited or unauthorized messages (“spam”), using contact lists obtained without consent, impersonating another person or organization, harvesting or scraping personal data, or transmitting content that is fraudulent, defamatory, obscene, threatening, or otherwise inappropriate. You must not upload or distribute viruses, malware, spyware, or any other malicious code. You are strictly prohibited from attempting to gain unauthorized access to any system, account, or network connected to Erino Services, from testing or probing system vulnerabilities, or from performing denial-of-service attacks or similar disruptive activities.

You may not reproduce, resell, sublicense, lease, or otherwise distribute Erino Services to third parties without prior written authorization. Reverse engineering, decompiling, or modifying any part of Erino Services is also prohibited. All use must be solely for the internal business purposes of the subscribing customer.

If you use Erino Services to send emails, SMS / Whatsapp messages, or make phone calls, you must ensure that all communications are compliant, accurate, and transparent. You may only contact individuals or entities that have provided verifiable consent or with whom you have an established business relationship. Every promotional or marketing communication must include clear sender identification and a functioning mechanism for the recipient to opt out or unsubscribe from future messages.

You are required to honor all opt-out, “do not call,” and “do not send” requests within the legally mandated period, or within ten business days where no specific time frame applies. Messages must not contain false, misleading, or deceptive content, and subject lines must accurately represent the message’s purpose. Transactional or service-related communications must be clearly distinguished from promotional material and may only be used for their legitimate purpose.

For telephone and Whatsapp / SMS usage, you must comply with all relevant telecommunications laws and industry standards, including requirements related to consent, identification, and message content. Automated calling or messaging systems may be used only in compliance with applicable consent and registration requirements. Where call recording functionality is used, you are responsible for obtaining all required permissions and ensuring compliance with local laws.

You must handle all personal data processed through Erino Services in accordance with applicable data protection and privacy regulations. This includes obtaining valid consent before collecting or using personal information, processing data only for lawful purposes, and implementing appropriate security measures to protect such data from unauthorized access, loss, or disclosure. You may not upload or store sensitive personal information, including but not limited to financial data, health records, or government identifiers, unless expressly required and permitted by law.

Erino acts as a data processor only with respect to Customer Data and relies on you to ensure that any data you submit or process complies with all applicable privacy and export-control laws. You are prohibited from transferring or storing personal data through Erino Services in violation of jurisdictional transfer restrictions. Repeated or willful breaches of privacy obligations may result in suspension or termination of your account.

You must maintain adequate technical and organizational controls to secure your access to Erino Services. This includes the use of strong authentication methods, regular credential rotation, and restricting access to authorized users. You are responsible for safeguarding any API keys, access tokens, or credentials issued to you by Erino and for preventing their misuse. You may not use Erino Services in a way that compromises or attempts to compromise the confidentiality, integrity, or availability of our systems or those of other users.

Testing, scanning, or penetration of Erino systems for vulnerabilities is not permitted without prior written authorization. Any attempt to circumvent or disable security features of Erino Services constitutes a material breach of this Policy and may result in immediate termination of service and legal action.

All information, files, and materials transmitted, stored, or published through Erino Services must be lawful, accurate, and appropriate. You may not distribute content that infringes on the intellectual property or proprietary rights of any party or content that promotes discrimination, violence, or illegal activity. Misrepresentation of identity or affiliation is strictly prohibited. Erino reserves the right to remove any content that it determines, in its sole discretion, to be in violation of this Policy or otherwise harmful to the operation or reputation of its platform or customers.

Erino reserves the right to monitor all use of its Services to ensure compliance with this Policy and applicable law. This may include automated or manual review of transmitted data, message metadata, usage logs, and related information. By using Erino Services, you consent to such monitoring for compliance, fraud detection, and security purposes.If Erino becomes aware of any actual or suspected violation, it may investigate the matter and take corrective measures as it deems appropriate. Such measures may include issuing a warning, requiring remedial action, temporarily suspending service, removing content, or terminating the offending account. Erino’s determination regarding Policy violations is final and binding.

You may not distribute content that infringes on the intellectual property or proprietary rights of any party or content that promotes discrimination, violence, or illegal activity. Misrepresentation of identity or affiliation is strictly prohibited. Erino reserves the right to remove any content that it determines, in its sole discretion, to be in violation of this Policy or otherwise harmful to the operation or reputation of its platform or customers.

Erino may suspend or terminate your access to the Services if it determines that your use violates this Policy, applicable law, or poses a risk to the security or integrity of the platform. For minor or inadvertent violations, Erino may provide notice and an opportunity to remedy the issue before suspension. However, in cases involving serious, repeated, or deliberate breaches, Erino may act immediately without prior notice.

Upon termination, Erino may disable your account, restrict access to Customer Data, and delete or retain data as required by law or as set forth in your subscription agreement. Erino shall not be liable for any loss, damage, or inconvenience resulting from suspension or termination under this Policy.

You agree to indemnify, defend, and hold harmless Erino, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, penalties, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your violation of this Policy, misuse of Erino Services, or infringement of any third-party rights. This obligation shall survive termination of your use of Erino Services.

You may not use or permit access to Erino Services in any jurisdiction or by any person prohibited under applicable export control or sanctions laws. You agree to comply fully with all relevant export restrictions, embargoes, and trade regulations, and represent that you are not located in or acting on behalf of any sanctioned country or entity.

Erino may temporarily disable your access or block specific content while it investigates suspected violations of this Policy. During such suspension, Erino has no obligation to preserve or deliver any affected data if the investigation confirms that a breach occurred. Temporary suspension is a precautionary measure and does not constitute a waiver of Erino’s right to pursue further enforcement or legal remedies.

Erino does not control or monitor all content or activities of its customers and disclaims responsibility for any communications, data, or actions carried out by users of the Services. You acknowledge that you are solely responsible for your conduct and for ensuring that your activities comply with this Policy and all applicable laws. Nothing in this Policy limits any other rights or remedies that Erino may have under applicable agreements or law.

Erino may amend this Policy from time to time to reflect legal, technical, or operational developments. The revised Policy will be posted on the Erino website and, where material changes are made, may be communicated through in-app notifications or email. Continued use of the Services after the effective date of any updated version constitutes acceptance of the revised Policy.

If any provision of this Policy is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Failure by Erino to enforce any right or provision of this Policy shall not be deemed a waiver of such right or provision.
